These Terms and Conditions (“Terms”) govern your access to and use of the CHEQIT platform, including the CHEQIT website, mobile applications, merchant tools, booking flows, payments, communications, and related services (collectively, the “Platform”).
By accessing or using the Platform, creating an account, making a booking, placing an order, using a merchant-facing feature, or otherwise interacting with CHEQIT through the Platform, you agree to be bound by these Terms.
Important notice
Please read these Terms carefully. They contain important provisions relating to eligibility, user conduct, bookings, payments, cancellations, suspensions, disclaimers, limitations of liability, and dispute handling. Nothing in these Terms is intended to exclude, restrict, or waive any right that cannot lawfully be excluded under applicable South African law.

| Charges | amounts payable in connection with a booking, session, order, service, transaction, deposit, balance, fee, or related platform flow. |
CHEQIT operates a technology platform that helps users discover, book, request, arrange, and pay for certain merchant offerings, and helps merchants manage profiles, offerings, availability, bookings, notifications, and related operational functions.
Unless CHEQIT expressly states otherwise in writing, CHEQIT is not itself the provider of the goods or services offered by third-party merchants through the Platform. The relevant merchant remains responsible for its own goods, services, staff, licensing, compliance, safety, fulfilment, quality, representations, and after-sales handling.
CHEQIT may facilitate communications, scheduling, payment flows, and other platform services connected to those transactions, but this does not make CHEQIT the merchant, employer, partner, insurer, guarantor, or agent of the merchant unless explicitly stated otherwise.
- You must be at least 18 years old to create an account or use the Platform as an account holder.
- You may only use the Platform if you have the legal capacity to enter into a binding agreement.
- You must provide accurate, current, and complete information when creating or using an account.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You may not sell, transfer, lend, or otherwise make your account available to another person without CHEQIT’s written permission.
- CHEQIT may require verification steps, including email verification, phone verification, identity verification, merchant KYC, or supporting documents before enabling certain features or maintaining access.
- CHEQIT may update, change, suspend, or discontinue any part of the Platform at any time.
- Features may differ by user type, merchant status, geography, device, or operational rollout stage.
- CHEQIT does not guarantee uninterrupted availability, error-free performance, or permanent availability of any feature.
- CHEQIT may introduce, remove, restrict, or modify features, commercial models, providers, or integrations from time to time.
You agree to use the Platform lawfully, fairly, and in accordance with these Terms.
You must not:
- use the Platform for unlawful, fraudulent, misleading, deceptive, abusive, or harmful purposes;
- submit false information, impersonate another person, or misrepresent your authority to act for a business;
- circumvent, interfere with, or attempt to bypass Platform payment flows, verification systems, or security controls;
- scrape, copy, reverse engineer, decompile, frame, mirror, or misuse the Platform except to the extent strictly permitted by law;
- upload malicious code, spam, exploit vulnerabilities, or impair the operation of the Platform;
- post or send abusive, defamatory, hateful, discriminatory, or unlawful content;
- submit fraudulent reviews, fabricated claims, or manipulated disputes;
- use the Platform in a way that infringes CHEQIT’s rights or the rights of any third party.
- Merchants are independent third parties and are not, by default, employees, partners, or agents of CHEQIT.
- Any contract for the supply of goods or services is primarily between the user and the relevant merchant, except to the extent CHEQIT expressly undertakes a separate obligation.
- Merchants are responsible for the accuracy of their listings, pricing, availability, licensing, content, policies, and service delivery.
- CHEQIT may review, suspend, remove, reject, or limit merchant content, accounts, offerings, or access where it reasonably considers that necessary for platform integrity, legal compliance, fraud prevention, safety, or operational reasons.
- The Platform may allow you to request, arrange, or confirm bookings, sessions, reservations, or orders with merchants.
- A booking or order may be subject to merchant confirmation, availability, merchant operating times, service constraints, payment verification, or other operational conditions.
- The Platform may collect booking details, scheduling details, free-text notes, images, preferences, and other information relevant to the booking or order.
- Merchants remain responsible for fulfilment, service delivery, no-show handling, merchant-side cancellation decisions, attendance policies, and service quality.
- CHEQIT may provide operational tools, reminders, receipts, fulfilment codes, payment-state updates, or related notices, but these tools do not make CHEQIT responsible for how the merchant performs the service.
Prices, fees, totals, deposits, and related charges may be shown through the Platform. Unless otherwise stated, the relevant merchant determines the price of its goods or services, while CHEQIT may apply platform-related fees, processing-related charges, or other disclosed charges where applicable.
- Displayed amounts may include deposits, balances, fees, service charges, taxes, or other amounts depending on the transaction.
- Pricing errors, availability issues, system issues, or obvious mistakes may result in correction, cancellation, or refusal before final fulfilment where lawfully permitted.
- CHEQIT may update platform fees, commercial models, or merchant service structures from time to time, subject to applicable law and any required notice.
Payments made through the Platform may be processed through one or more designated third-party payment processors used by CHEQIT from time to time.
- By submitting payment information or proceeding with a payment flow, you authorise CHEQIT and its designated payment processor(s) to process the relevant charge.
- CHEQIT may facilitate payment collection on behalf of a merchant where the Platform is configured to do so.
- Payment verification, settlement, refunds, payout allocation, and related records may be processed through platform workflows and designated payment partners.
- Where a payment method fails, expires, is declined, or cannot be charged, CHEQIT may restrict access to the relevant transaction or feature until the payment issue is resolved.
- Receipts, confirmations, payment notices, and related records may be sent electronically.
Cancellation, reschedule, refund, lateness, and no-show outcomes may depend on the type of offering, merchant policy, transaction stage, operational timing, and applicable law.
- Deposits may be non-refundable unless otherwise stated, required by law, or unless a merchant-initiated cancellation or other platform rule makes a refund applicable.
- CHEQIT may facilitate refunds through the Platform where a refund is approved or triggered by the applicable rule set.
- A merchant-initiated cancellation may result in a different outcome from a user cancellation, including full or partial refund treatment depending on the applicable rule set and fees already incurred.
- Platform-related or processing-related fees may be non-refundable to the extent lawfully permitted and clearly disclosed.
- Reschedules, late arrivals, no-shows, expiry, and related events may affect whether a transaction remains valid, refundable, or claimable.
- Nothing in these Terms limits any consumer right that cannot lawfully be excluded under applicable law.
If you have a complaint or dispute relating to a merchant offering, booking, payment, or use of the Platform, you should contact CHEQIT using the support details made available by CHEQIT and, where relevant, the applicable merchant.
- CHEQIT may review complaints, payment issues, or incident reports to the extent relevant to its platform role.
- Merchants remain responsible for complaints arising primarily from their own goods, services, staff conduct, fulfilment, representations, or service quality.
- CHEQIT may request information, documentation, images, confirmations, or supporting records in connection with a complaint, chargeback, or dispute.
- CHEQIT may cooperate with payment providers, merchants, professional advisers, insurers, regulators, or law enforcement where reasonably necessary.
You may be able to submit text, images, reviews, notes, profile information, merchant content, or other materials through the Platform.
- You remain responsible for content you submit.
- You represent that you have the right to submit that content and that it does not violate law or third-party rights.
- By submitting content through the Platform, you grant CHEQIT a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, adapt, and use the content as reasonably necessary to operate, improve, secure, market, and administer the Platform.
- CHEQIT may remove, refuse, restrict, or moderate content in its discretion where reasonably necessary for legal, safety, operational, or platform integrity reasons.
- The Platform, including its software, design, workflows, branding, text, graphics, databases, interfaces, and related materials, is owned by CHEQIT and/or its licensors and is protected by applicable law.
- Nothing in these Terms transfers ownership of CHEQIT’s intellectual property to you.
- CHEQIT grants you a limited, revocable, non-exclusive, non-transferable licence to use the Platform for its intended purpose and subject to these Terms.
- You may not use CHEQIT’s name, logos, trade dress, trademarks, or other brand features without CHEQIT’s prior written consent.
CHEQIT processes personal information in accordance with its Privacy Policy. By using the Platform, you acknowledge that CHEQIT may collect, use, store, disclose, and otherwise process personal information as described in the Privacy Policy and as necessary to provide the Platform, protect users, process payments, support merchants, manage complaints, and comply with law.
Where CHEQIT shares personal information with merchants or service providers in connection with a booking, payment, compliance requirement, or operational flow, such sharing must be understood as part of the functioning of the Platform and subject to CHEQIT’s Privacy Policy and any separate agreement that applies.
- The Platform may rely on or link to third-party services, payment pages, merchant pages, communications services, storage services, or external websites.
- CHEQIT does not control every third-party service and is not responsible for the content, availability, performance, or privacy practices of those third parties.
- Your use of third-party services may also be subject to their own terms and policies.
You consent to receive electronic communications from CHEQIT where permitted by law, including account notices, service messages, booking notices, receipts, verification messages, support messages, legal notices, and updates delivered through email, SMS, push notifications, or the Platform.
You are responsible for keeping your contact details current. CHEQIT is not responsible for missed notices resulting from inaccurate or outdated contact information supplied by you.
- CHEQIT may suspend, restrict, deactivate, or terminate your access to the Platform, or any feature of it, if CHEQIT reasonably believes that you have breached these Terms, created risk, engaged in misconduct, submitted false information, interfered with the Platform, or exposed CHEQIT, merchants, users, or the public to harm or liability.
- CHEQIT may also suspend or restrict accounts pending verification, complaint review, payment review, fraud checks, legal review, or compliance review.
- You may stop using the Platform at any time. Account removal may result in deactivation rather than immediate deletion of all records, subject to legal and operational retention requirements.
- Termination or suspension does not affect rights, obligations, liabilities, payment duties, accrued claims, or provisions intended to survive termination.
The Platform is provided on an “as is” and “as available” basis to the maximum extent permitted by law.
- CHEQIT does not warrant that the Platform will always be uninterrupted, secure, available, accurate, or error free.
- CHEQIT does not guarantee the quality, suitability, legality, safety, timing, or performance of any third-party merchant or merchant offering.
- CHEQIT does not guarantee that any booking request, order, payment, refund, or merchant service will ultimately be accepted, completed, or fulfilled.
- System delays, outages, data transmission issues, and third-party failures may affect Platform performance.
These disclaimers apply only to the extent permitted by law and do not override non-excludable statutory rights.
To the maximum extent permitted by law, CHEQIT will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profit, loss of goodwill, loss of business opportunity, or loss of data arising from or connected to the Platform.
To the maximum extent permitted by law, CHEQIT’s aggregate liability for claims arising from or relating to the Platform will be limited to the amount paid by you to CHEQIT directly in connection with the specific transaction giving rise to the claim during the six months preceding the event giving rise to the claim, or such higher amount as may be required by applicable law.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, or any liability that cannot lawfully be excluded or limited under applicable law.
To the maximum extent permitted by law, you agree to indemnify and hold CHEQIT, its affiliates, licensors, officers, employees, and service providers harmless from and against claims, losses, damages, liabilities, costs, and expenses arising out of or connected with:
- your breach of these Terms;
- your misuse of the Platform;
- your infringement of any third-party rights;
- your content, representations, or unlawful conduct;
- your dealings with merchants or other users except to the extent caused by CHEQIT’s own unlawful conduct or non-excludable liability.
You agree to comply with all laws applicable to your use of the Platform. CHEQIT intends these Terms to operate consistently with applicable South African law, including laws governing electronic transactions, consumer protection, privacy, and lawful contracting.
If any provision of these Terms is inconsistent with a right or remedy that cannot lawfully be excluded, restricted, or waived, that provision must be read subject to the applicable law and only to the extent necessary to preserve compliance.
- CHEQIT may update these Terms from time to time.
- When CHEQIT makes material changes, CHEQIT may give notice through the Platform, by email, or by other appropriate means before or when the changes take effect.
- Your continued use of the Platform after the effective date of an updated version constitutes acceptance of the updated Terms, to the extent permitted by law.
These Terms are governed by the laws of the Republic of South Africa. Subject to applicable law and any mandatory dispute-resolution rights, you agree that the courts of South Africa will have jurisdiction in relation to disputes arising out of or connected with these Terms or the Platform.
- If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force to the extent possible.
- CHEQIT’s failure to enforce any provision is not a waiver of its right to do so later.
- You may not cede, assign, or transfer your rights or obligations under these Terms without CHEQIT’s prior written consent.
- CHEQIT may assign or transfer its rights or obligations where reasonably necessary in connection with a restructuring, financing, sale, merger, or platform reorganisation.
- These Terms, together with any referenced policies and any applicable supplemental terms, form the agreement between you and CHEQIT regarding the Platform.
